INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in April 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in April 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Feeds Act : S.C. 2015, c. 2 adds section 9.1 to authorize inspectors to order that certain unlawful imports be removed from Canada or destroyed. Changes are required that a registration or a licence be obtained for conducting certain activities in respect of prescribed feeds, or supplements that have been imported for sale or that are to be exported or to be sent or conveyed from one province to another. These amendments authorize the Minister to issue certificates setting out information that he or she considers necessary to facilitate certain exports and authorizes the Minister to consider information from foreign reviews when considering certain applications. .

Section 2.B Canada Regulations

Class I Nuclear Facilities Regulations (Nuclear Safety and Control Act): SOR/2015-67 amends the regulations to clarify and make the requirements easier to understand and implement. As well the regulations are being amended to bring them more in line with their legislative authority.

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2015-59 adds 8 substances to Part 1 and adds 7 substances to Part 3. SOR/2015-73 deletes 1 substances from Part 1 and adds 1 substance to Part 2.

Metal Mining Effluent Regulations (Fisheries Act): SOR/2015-45 amends the regulation to add a pond and portions of three creeks to Schedule 2 of the MMER. Waste rock and tailings from the Detour Lake Gold Mine can therefore be deposited into these fish-frequented water bodies, subject to compliance with this regulation. It is expected that the infilling of these water bodies with tailings and waste rock will begin in 2019.

Nuclear Security Regulations (Nuclear Safety and Control Act): SOR/2015-67 amends the regulations to clarify and make the requirements easier to understand and implement. As well the regulations are being amended to bring them more in line with their legislative authority.

Nuclear Substances and Radiation Devices Regulations (Nuclear Safety and Control Act): SOR/2015-67 amends the regulations correcting minor inconsistencies and discrepancies between its French and English versions. The amendments clarify and make the requirements easier to understand and implement. As well the regulations are being amended to bring them more in line with their legislative authority.

Uranium Mines and Mills Regulations (Nuclear Safety and Control Act): SOR/2015-67 amends the regulations to clarify and make the requirements easier to understand and implement. As well the regulations are being amended to bring them more in line with their legislative authority.

Storage Tank System Management Regulation (Government Organization Act): Alta Reg. 16/2015 amends the expiry of this regulation to read February 28, 2020.

Permit Regulation (Safety Codes Act): Alta. Reg. 17/2015 amends the regulation to add a definition for "sheet metal worker". References to sheet metal workers have also been added to the regulation. Section 19 (Permit information) has been repealed and replaced. In addition to some other refinements of the text, the expiry date has been updated to January 31, 2017.
