INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in October 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in October 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Section 2.B Canada Regulations

Canada - Nova Scotia Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations (Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act): SOR/2017-116 makes amendments to provide greater flexibility for offshore workplaces to meet requirements by recognizing international standards for maritime safety for the shipping industry, international equivalencies for technical standards; and to allow for the most recent version of standards (ambulatory references) to prevail.

SOR/2017-158 adds 6 substances to Part 1, adds 7 substances to Part 3 and adds 2 substances to Part 4. SOR/2017-163 adds 2 substances to Part 1 and adds 13 substances to Part 3. Non-Smokers Health Protection and Vapour Products Act: S.M. 2015, c. 36 is in force changing the title to include vapour products and amending sections with respect to exceptions, advertising and prohibiting the supply of vapour products to children.

Workplace Safety and Health Act: S. M. 2015, c. 36 comes into force 01/10/17 replacing clause 18(1)(c.1) referring to the prohibition of smoking and e-cigarette use at workplaces.

Section 2.A Northwest Territories Acts

Environmental Protection Act : S.N.W.T. 2017, c. 17 removes the non-application provision, and extends the authority of the Minister to establish and make publicly available a register respecting environmental contaminants, to determine that discharges are nuisances and to exempt persons from complying with the Act or regulations. Persons intending to discharge contaminants are required to register with the Minister, obtain a license or permit and provide the prescribed information.

Oil and Gas Operations Act : S.N.W.T. 2017, c. 20 amends s. 1 to reference the Inuvialuit Settlement Region.

Public Health Act : S.N.W.T. 2017, c. 18 amends s. 50 to include cremation and crematoriums.

Territorial Parks Act : S.N.W.T. 2017, c. 20 amends s. 14 to make a grammatical correction.

The defendant was also ordered not to be involved in any capacity, other than being an employee, in a business for the period of one year. A fine of $1,000 for each of 31 counts was imposed against the company. The court also imposed a 25-per-cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
FGF Brands Inc., 475 North Rivermede Road, Concord, Ontario, a commercial food manufacturing company that produces baked goodsOctober 13, 2017FGF Brands Inc. pleaded guilty and was fined $70,000 for failing as an employer to ensure that the measures and procedures in section 76 of the Ontario Regulation 851/90 - the Industrial Establishments Regulation - were carried out in the workplace. The regulation states that where the starting of a machine, transmission machinery, device or thing may endanger the safety of a worker, control switches or other control mechanisms shall be locked out and other effective precautions necessary to prevent any starting shall be taken. The court also imposed a 25-per-cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime. Lafarge Canada Inc., 6509 Airport Road, Mississauga, OntarioOctober 12, 2017Lafarge Canada Inc. was fined $115,000 after pleading guilty to the offence of failing as an employer to ensure that the power supply to an electrical installation, equipment or conductors was disconnected, locked out of service and tagged before any work was done and while being done on or near live exposed parts of the installations, equipment or conductors. This is an offence contrary to section 25(1)(c) of the OHSA. The court also imposed a 25-per-cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
Drummond Metal Fabrication Ltd., formerly known as Repath Industries Ltd., 39 Drummond St., Toronto, OntarioOctober 2, 2017Drummond Metal Fabrication Ltd. was fined $50,000 after being found guilty as an employer of the following offences:Failing to ensure that a machine was shielded or guarded so that the product or material being processed does not endanger the safety of a worker as prescribed by section 26 of Ontario's Regulation 851/Industrial Establishments Regulation, contrary to section 25(1)(c) of the Occupational Health and Safety Act (OHSA). Failing to ensure that a worker was wearing apparel sufficient to be protected from injury from a spinning metal plate as prescribed by section 84(e) of Ontario Regulation 851, contrary to section 25(1)(c) of the OHSA.
Toronto Crane Service Inc., 360A Deerhide Crescent, Toronto, OntarioSeptember 6, 2017Toronto Crane Service Inc. was fined $95,000 after pleading guilty to the offence of failing to ensure that the measures and procedures prescribed by section 46 of Ontario Regulation 851/the Industrial Establishments Regulation were carried out in the workplace, contrary to section 25(1)(c) of the Occupational Health and Safety Act (OHSA). The court also imposed a 25-per-cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
Dayus Roofing Inc., 5120 Halford Road, Windsor, OntarioJuly 17, 2017Dayus Roofing Inc. pleaded guilty to the offence of failing, as an employer, to ensure that the measures and procedures prescribed by section 26.1(2) of Ontario Regulation 213/91 (the Construction Projects Regulation), were carried out in the workplace. This requires an employer to adequately protect workers with a guardrail system, or with another fall protection method such as a travel restraint system, a fall restricting system or a fall arrest system. This failure was contrary to section 25(1)(c) of the Occupational Health and Safety Act. Dayus Roofing was fined $90,000 in Provincial Offences Court/Ontario Court of Justice, 251 Goyeau Street, Windsor, by Justice of the Peace Susan E. Whelan; Crown Counsel Shantanu Roy. The court also imposed a 25-per-cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
Rex Pak Limited, 85 Thornmount Drive, Toronto, OntarioOctober 4, 2017Rex Pak Limited pleaded guilty to two charges of failing to comply with orders issued by a health and safety inspector and was fined $60,000.
