INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in June 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in June 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada-Newfoundland and Labrador Atlantic Accord Implementation Act : S.C. 2015, c. 4 makes extensive amendments to increase transparency, update and strengthen spill prevention, response and liability.

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act : S.C. 2014, c. 13 makes extensive amendments to establish a new occupational health and safety regime in the offshore areas. The purpose of the amendments is to: (a) ensure that occupational health and safety officers, special officers, conservation officers and operational safety officers have the same powers for the administration and enforcement of the Accord Acts; (b) clarify that the new occupational health and safety regime applies to the transportation of persons who are in transit to, from or between workplaces in the offshore areas; (c) require that any occupational health and safety regulations that apply to the transportation of persons who are in transit to, from or between workplaces in the offshore areas be made on the recommendation of the Minister of Transport; and (d) authorize each of the Canada-Newfoundland and Labrador Offshore Petroleum Board and the Canada-Nova Scotia Offshore Petroleum Board to publicly disclose information related to occupational health and safety if it considers it to be in the public interest. S.C. 2015, c. 4, most sections are now in force to increase transparency, update and strengthen spill prevention, response and liability. S.C. 2015, c. 39 amends sections 104 and 141.

Canada Oil and Gas Operations Act : S.C. 2015, c. 4, remaining sections are in force making extensive amendments regarding cost recovery, transboundary pools or fields and administrative monetary penalties. S.C. 2015, c. 21 is also in force making amendments related to abandoned pipelines.

National Energy Board Act : S.C. 2015, c. 21 is in force making extensive amendments related to reinforcing the "polluter pays" principle. Amendments confirm the liability of companies that operate pipelines, require companies to maintain financial resources necessary to pay the limit of liability that applies to them, allows the National Energy Board to take measures related to abandoned pipelines and uncontrolled releases and recover funds from companies.

Section 2.B Canada Regulations

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2016-80 adds 12 substances to Part 1 and adds 4 substances to Part 3. SOR/2016-94 adds 5 substances to Part 1 and adds 6 substances to Part 3.

Ministry of Labour Proposes to Mandate Construction Hazard Awareness Training

The Ministry of Labour is consulting on a proposal to amend the Occupational Health and Safety Awareness and Training Regulation (O. Reg. 297/13) under the Occupational Health and Safety Act to mandate hazard awareness training for construction workers.

Petrochemical - Industry Standard under the Local Air Quality Regulation (O. Reg. 419/05) (source: Environmental Registry)

In 2013, the Chemistry Industry Association of Canada (CIAC) approached the Ministry of the Environment and Climate Change (MOECC) with a request to develop a proposed Technical Standard under the Local Air Quality Regulation (O. Reg. 419/05: Air Pollution - Local Air Quality) for benzene and 1,3-butadiene. In practical terms, a technical standard provides a prescriptive set of air pollution control requirements that focus on key contributors to off-site concentrations of priority air toxics.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Highway Traffic Act : S.O. 2016, c. 5, s. 3 is in force adding subsection 50(3) regarding extension of time to appeal decisions.

Provincial Offences Act : S.O. 2015, c. 27 adds a definition of "electronic" and "electronically" in subsection 1(1); replaces section 76.1; and, amends section 87.

Section 2.B Ontario Regulations

Construction Projects (Occupational Health and Safety Act) : O. Reg. 345/15 amends subsection 26.1(3), section 47, and section 176. Replaces sections 78 to 83 regarding Ladders, and up-dates the Table in subsection 144(6). Also adds new sections 156.1 to 156.9 regarding Rotary Foundation Drill Rigs. These amendments come into force on July 1, 2016.

Industrial Establishments (Occupational Health and Safety Act): O. Reg. 382/15 is in force July 1, 2016 repealing s. 139 regarding noise measurement and protection.

Workplace Hazardous Materials Information System (Occupational Health and Safety Act): O. Reg. 168/16 is in force July 1, 2016 making amendments to align with WHMIS 2015 requirements.

Tobacco Control Act (L-6.2) (formerly Tobacco Act): S.Q. 2015, c. 28, sections are in force changing the title of the act and making extensive amendments, including the addition of electronic cigarettes to tobacco products, further restrictions to smoking in enclosed spaces and outdoors, tightening of standards applicable to the tobacco trade, and increased fines and accountability.
