INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in November 2014. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in November 2014. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2014 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Territorial Lands Act: Regulations Amending the Territorial Land Use Regulations Vol. 148, No. 21

Vessel Pollution and Dangerous Chemicals Regulations (Canada Shipping Act, 2001): Proposed regulations are found in the Canada Gazette, Part I, Nov. 5, 2011, p. 3416. Proposed amendments are found in the Canada Gazette, Part I, July 21, 2012, p. 2119.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canadian Environmental Protection Act, 1999: S.C. 2012, c. 19 is now partly in force and amends the Act to provide the Minister of the Environment with the authority to renew disposal at sea permits in prescribed circumstances. It is also amended to change the publication requirements for disposal at sea permits and to provide authority to make regulations respecting time limits for their issuance and renewal.

Canada Labour Code (Part II): S.C. 2013, c. 40 amends the regulation to remove references to health and safety officers and regional health and safety officers.

Non-Smokers' Health Act: S.C. 2013, c. 40 amends the Act to remove references to health and safety officers and regional health and safety officers and add a new definition for ‘inspector’ under section 2.

Hazardous Materials Information Review Act: Section 201 of S.C. 2013, c. 40 is now in force and amends the Act to remove references to health and safety officers and regional health and safety officers.

Alberta Ambient Monitoring Funding Regulation: Regulation Environmental Protection and Enhancement Act

Division 2 ALBERTA AMENDMENTS

Administrative Penalty Regulation (Climate Change and Emissions Management Act): Alta. Reg. 137/2014 amends the regulation’s expriy in section 5.

Coal Conservation Rules (Coal Conservation Act): Alta. Reg. 140/2014 amends wording in s. 90.

Conservation and Reclamation Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 169/2014 changes the expiry date of the regulation to June 30, 2016 in s. 25.1.

Nuisance and General Sanitation Regulation (Public Health Act): Alta. Reg. 162/2014 adds the definitions for “event” and “operator” to s. 1 and amends ss. 2, 5-9, 15, 19 and the Schedule. Sections 16 and 17 are repealed.

Pressure Equipment Exemption Order (Safety Codes Act): Alta. Reg. 158/2014 amends ss. 2 and 4 and adds s. 2.1 Exemptions. http://www.ccohs.ca/legislation/documents/alta/abesafe/abrpexe0.xml Pressure Equipment Safety Regulation (Safety Codes Act): Alta. Reg. 158/2014 repeals s. 3.

Pressure Welders Regulations (Safety Codes Act): Alta. Reg. 103/2014 amends the regulation to add a definition for pressure tack welder and welding examiner in training as well as adding references to these positions throughout.

Specified Enactments (Jurisdiction) Regulation (Responsible Energy Development Act): Alta. Reg. 148/2014 amends s. 19 and Schedules 2 and 6.

Waiver Regulation (Public Health Act): Alta. Reg. 152/2014 amends ss. 2 and 11 and replaces s. 9 (Committees).

Division 2 MANITOBA AMENDMENTS

Section 2.A Manitoba Acts

Highway Traffic Act: S.M. 2013, c. 24 is now in force. Amendments to sections 68 and 86 (as well as the addition of section 86.1) provide more flexibility for short-term and seasonal variations in permissible vehicle weights and dimensions. Amendments allow the Minister, or his delegate, to make seasonal orders, short-term orders, of up to two years. These changes are in addition to the current power of the minister to make regulations for longer-term prohibitions and restrictions. Other amendments include uniform penalties for weight-based offences and the clarification of powers possessed by other traffic authorities.

Workers' Compensation Act: S.M. 2014, c. 31 is now partly in force. A definition for Chief Prevention Officer has been added to the Act as well as amendments referencing this position and its role and powers. As well, references to the new prevention committee have been added throughout. Additional amendments will come into force in 2015.
