INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in August 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in August 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Section 2.A Canada Acts

Canada Marine Act : S.C. 2016, c. 7, s. 232 adds s. 25.2 (Payments to Canada Place Corporation) regarding payments for Canada Day celebrations.

Loi Maritime du Canada

Canada Transportation Act: S.C. 2014, c. 8, sections are in force repealing paragraph 116(4)(c.1), ss. 116.1-116.3, and subsections 128(1.1), 169.31(1.1), 177(3) and 179(1.1). S.C. 2015, c. 31, s. 38 is in force replacing subsections 178(1) (notices of violation) and 180.8(2) (delegation by Minister).

Loi sur les transports au Canada

Canadian Environmental Protection Act, 1999 : SOR/2016-120 amends item 65 of Schedule to add z.19 - z.34 (volatile organic compounds). SOR/2016-150 adds item 133 to Schedule 1 (plastic microbeads less than or equal to 5mm in size).

Consumer Chemicals and Containers Regulations , 2001 (Canada Consumer Product Safety Act): SOR/2016-170 makes non-substantive administrative changes to the regulations.

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2016-158 adds 3 substances to Part 1 and adds 15 substances to Part 3. SOR/2016-159 removes 1 item from Part 5 and adds 1 item to Part 6

Mines Act : S.B.C. 2016, c. 7, s. 2 is in force increasing the penalty to $1,000,000 and up to 3 years imprisonment in s. 37 (Offence and penalty).

Protected Areas of British Columbia Act : S.B.C. 2016, c. 14 except s. 2 is in force amending park descriptions in Schedules C to E.

Wildlife Act: S.B.C. 2016, c. 11, sections are in force repealing subsections 11(7) and 17(2), adding s. 40.1 (Issue of trapping licence) and amending ss. 54-55, and 84.

Waste Discharge Regulation (Environmental Management Act): B.C. Reg. 54/2016 repeals s. 4.1 and item 7 (Code of Practice for the Discharge of Produced Water from Coalbed Gas Operations) from the Table in Schedule 2.

Division 2 NOVA SCOTIA AMENDMENTS

Section 2.A Nova Scotia Acts

Motor Vehicle Act : S.N.S. 2015, c. 45 s. 8 is in force amending s. 98 regarding the removal of personal information from reports. S.N.S. 2015, c. 46 except s. 17 is in force making amendments related to personal transporters.

Section 2.B Nova Scotia Regulations

Activities Designation Regulations (Environment Act): N.S. Reg. 58/2016 adds s. 9A and amends ss. 10 and 30. N.S. Reg. 120/2016 amends ss. 6, 9, 17, and 28.

Dangerous Goods Management Regulations (Environment Act): N.S. Reg. 57/2016 replaces the definition of "dangerous goods" in s. 2, repeals the definition of "primary classification" and adds definitions for PCBs. Sections 5, 6, 9 are also amended and Schedule A is replaced. Schedule B is repealed.

Fees Regulation (Environment Act): N.S. Reg. 69/2016 amends s. 11 to add Category IV activities at the end of Table 5 in 1(1).

Helmet Regulations (Motor Vehicle Act): N.S. Reg. 85/2016 adds 2(d) the Economic Commission for Europe.

Regulations under the Waste Diversion Transition Act, 2016

The Ministry of the Environment and Climate Change is proposing regulations under the Waste Diversion Transition Act, 2016 (WDTA) for the purposes of transferring the four waste diversion programs to the WDTA. Until the programs are wound-up and the wastes managed under the programs are transitioned to the new producer responsibility framework under the Resource Recovery and Circular Economy Act, 2016, the programs will operate under the WDTA.

Green Energy Act , 2009: S.O. 2016, c. 10, Schedule 1 is in force replacing s. 6 (Public agency, energy conservation and demand management plan) and s. 7 (Prescribed person, reporting of energy consumption and water use) and adding ss. 7.1-7.3 regarding prescribed persons submitting energy conservation and demand management plans and the release of information. The heading to Part III and s. 16 are also amended.

Occupational Health and Safety Act : S.O. 2015, c. 27, Sch. 4, sections are in force making amendments related to WHMIS 2015 in ss. 37-38, 40-40.1, 57 and 70.

Public Hospitals Act : S.O. 2014, c. 14, Sch. 2, s. 8 is in force amending s. 33 (Notice to college of disciplinary action against physician) regarding the resignation of a physician which may be related to the competence, negligence or conduct of the physician.

Section 2.B Ontario Regulations

Commercial Motor Vehicle Inspections (Highway Traffic Act): O. Reg. 256/15 is in force making amendments regarding motor coaches and their maintenance and performance standards.

Construction Projects (Occupational Health and Safety Act): O. Reg. 242/16 sections are in force amending the definition of rotary foundation drill rig in s. 1, and amending ss. 67 (protection of workers on a freeway involving a mobile operation) and s. 148 (fall protection on elevating work platforms).

Functional Abilities Form (Workplace Safety and Insurance Act, 1997): O. Reg. 124/16 replaces clause 1(a) to indicate that the Form for Planning Early and Safe Return to Work is available on the WSIB website.

General (Environmental Bill of Rights, 1993) : O. Reg. 117/16 amends ss. 1-2 to reference the Treasury Board Secretariat and s. 3 to reference the Invasive Species Act, 2015 and the Places to Grow Act, 2005.

General (Off-Road Vehicles Act) : O. Reg. 135/16 replaces paragraph 1 in Schedule 1 (King’s Highway). O. Reg. 182/16 replaces paragraph 1 in Schedule 1 again and adds paragraphs 37-39.

Fish Licensing (Fish and Wildlife Conservation Act, 1997) : O. Reg. 119/16 amends dates in ss. 1, 14 and 34.0.1 and adds Barramundi and Giant freshwater river prawn to Schedule B.

Mines and Mining Plants (Occupational Health and Safety Act): O. Reg. 167/16, some sections are in force replacing the definition of "non-combustible" in s. 1, amending ss. 11.1, 71, 196, 248, 281.1, and 289 and adding s. 11.1 regarding surface diamond driller training programs and s. 196.1 regarding emergency stopping systems for conveyors. Sections 24, 167 and 188 are repealed.

Registrations Under Part II.2 of the Act - Water Taking (Environmental Protection Act): O. Reg. 118/16 amends ss. 2 and 7 regarding permits in effect as of March 29, 2016 issued under the Ontario Water Resources Act.
