INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in August 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in August 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of August 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Canada Occupational Health and Safety Regulations (Canada Labour Code (Part II - Occupational Safety and Health)) : SOR/2017-132 makes amendments related to the occupational exposure limit including: removing the current OEL of one fibre per cubic centimetre for airborne chrysotile asbestos; reducing the OEL for all forms of airborne asbestos fibre to as close to zero as reasonably practicable and not exceeding the value adopted by the ACGIH®, in its publication entitled Threshold Limit Values (TLVs) and Biological Exposure Indices (BEIs) as amended from time to time, which is currently 0.1 f/cc; repealing the definition of airborne chrysotile asbestos to replace it by a definition of asbestos that would include all forms of asbestos, namely actinolite, amosite, anthophyllite, chrysotile, crocidolite and tremolite; and, adding definitions of: airborne asbestos fibre, asbestos-containing material, clearance air sampling, containment system, encapsulation, enclosure, friable, glove bag, HEPA filter, high-risk activity, low-risk activity, moderate-risk activity and work activity. The amendments also include new provisions that prescribe the requirements for an asbestos exposure management program where asbestos-containing material is disturbed or exposed in a work place and where there is the potential for a release of asbestos fibre or employee exposure to airborne asbestos fibre. The Asbestos Exposure Management Program includes obligations for employers to ensure that an Asbestos Exposure Control Plan is developed, implemented and administered for employees involved in asbestos-related work activities, including procedures and control measures for moderate-risk activities and high-risk activities and an employee education and training program.

Drive Clean-Remote On-Board Diagnostic Testing Program Regulatory Amendments

The Ministry of the Environment and Climate Change (MOECC) is proposing amendments to Ontario Regulation 361/98 (Motor Vehicles), made under the Environmental Protection Act (EPA). If approved, the regulatory amendments would enable emissions testing using remote on-board diagnostics (OBD) technologies. Additionally, minor housekeeping changes are being proposed to ensure that the regulation is up-to-date.

Amendments to Ontario Regulation 455/09 and creation of a new services documents regulation under the Toxics Reduction Act

The Ministry of the Environment and Climate Change is proposing a number of minor amendments to O. Reg. 455/09 aimed to reduce reporting burden, simplify the toxic substance reduction planning process, adjust the schedule and timing of the plan review process, protect business confidentiality, clarify language and intent, better align with the National Pollutant Release Inventory where appropriate, and correct minor errors. In addition, MOECC is proposing a new service of documents regulation.

Act to affirm the collective nature of water resources and to promote better governance of water and associated environments : S.Q. 2017, c. 14 creates the new act title (formerly titled Act to affirm the collective nature of water resources and provide for increased water resource protection); adds new section 3.1 proclaiming June as Water Month; adds new sections 13.1 to 13.7; adds Divisions IV.1 and VI; and amends various other sections.
