INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in June 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in June 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Off-Highway Vehicle Regulation (Traffic Safety Act): Alta. Reg. 72/2017 adds section 9.1 applying to a safety helmet that is intended for the use of a driver or operator of an off-highway vehicle or of a person riding in or on, or being towed by, an off-highway vehicle. Amends section 44 Offences, and repeals section 45.1 Expiry.

Passenger Ropeways and Passenger Conveyors Standards Regulation (Safety Codes Act): Alta. Reg. 78/2017 up-dates references to the new CSA Z98-14, Passenger ropeways and passenger conveyors in several sections.

Administrative Penalties Regulation under the Waste Diversion Transition Act, 2016

The Resource Productivity and Recovery Authority (the "Authority") is responsible for the oversight of existing programs under the WDTA and the producer responsibility scheme under the RRCEA, including compliance and enforcement under both acts. The proposed regulation would govern the determination of the amount of, and the manner in which Authority staff will issue an order to pay an administrative penalty for non-compliance with the WDTA and its regulations.

Amendment to Ontario Regulation 73/94 under the Environmental Bill of Rights (EBR) to prescribe the Ministry of Education for Applications for Review

The Environmental Bill of Rights, 1993 (EBR) provides a number of opportunities for the public to influence and be involved in the Ontario Government's environmental decision-making process. The proposed amendment would expand the scope of the application for review provisions under EBR to the Ministry of Education and provide residents of Ontario the opportunity to participate in the ministry's environmental decision making.

Amendment to Ontario Regulation 316/07 under the Provincial Parks and Conservation Reserves Act, 2006 to add land to Stoco Fen Provincial Park.

Stoco Fen Provincial Park is a 203 ha nature reserve class park that was established in 1985. The park protects most of the open fen component of the provincially significant Stoco Fen wetland and Area of Natural and Scientific Interest. The Ministry of Natural Resources and Forestry (MNRF) is proposing to regulate three parcels of land. Adding these lands to the park will further protect sensitive wetland habitat and headwater areas.

Proposal to amend O.Reg. 404/12 (Energy and Water Efficiency - Appliances and Products) under the Green Energy Act, 2009 ("Efficiency Regulation").

Proposed amendment to Lakes and Rivers Improvement Act Dam Construction Regulation (Ontario Regulation 454/96) to specify that approval is not required for alterations, improvements and repairs to existing dams in cases where they are governed by an agreement between the Minister and the dam owner.

The Ministry of Natural Resources and Forestry is seeking comments on a proposal to amend Ontario Regulation 454/96 under the Lakes and Rivers Improvement Act to enable 2016 policy for entering into agreements for alterations, improvements and repairs to existing dams. The proposed amendment will allow MNRF to govern alterations, improvements and repairs to existing dams for qualified dam owners through an agreement, and remove the duplicative requirement for LRIA section 16 approvals.
