INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in April 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in April 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Transportation Act : R.S.B.C. 2015, c. 1, RevSch. updates references to the Local Government Act which has been revised.

Water Protection Act : S.B.C. 2014, c. 15 is in force amending definitions in s. 1 and updating references to the Water Sustainability Act.

Water Users’ Communities Act (formerly Water Act): S.B.C. 2014, c. 15 is in force changing the title of the Act, repealing most of the Act and enacting the Water Sustainability Act in substitution.

Workers' Compensation Act : B.C. Reg. 220/2015 makes consumer price index adjustments.

Highway Traffic Act : S.M. 2015, c. 43 amends s. 134 (Stopping at uncontrolled railway crossings and required stopping distances - certain buses and trucks) as well as amendments related to "specified offences related to obtaining sexual services or procuring". S.M. 2013, c. 50, s. 5 is in force adding s. 185.1 (Safety measures for wheel-bound passengers). S.M. 2015, c. 39 is in force making amendments related to license suspensions related to designated offences.

Section 2.B Manitoba Regulations

Classes of Development Regulation (Environment Act): Man. Reg. 39/2016 amends and adds to Definitions, updates sections 2 and 3, repeals section 5, and adds section 6.

Special Waste (Shredder Residue) Regulation (Dangerous Goods Handling and Transportation Act): Man. Reg. 38/2016 revises the definition of "Class 1 waste disposal ground."

Water and Wastewater Facility Operators Regulation (Environment Act): Man. Reg. 209/2015, sections 3 and 14 are now in force adding s. 1.1 (Interpretation: "continuing education unit") and replacing Schedule B (Qualifications) respectively.
