INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in March 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in March 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada Labour Code : S.C. 2014, c. 20 is partly in force amending the Act in accordance with the Regulatory Cooperation Council Joint Action Plan initiative for work place chemicals. This amendments is part of implementing the Globally Harmonized System of Classification and Labelling of Chemicals with respect to, among other things, labelling and safety data sheet requirements.

Code canadien du travail

Motor Vehicle Safety Act : S.C. 2014, c. 20 is now partly in force. These amendments align of Canadian and U.S. regulations introducing measures to streamlining the process and reducing the administrative requirements for manufacturers and importers. Safety is being considered through amended oversight procedures and increased availability of vehicle safety information.

Section 2.B Canada Regulations

Canada Industrial Relations Board Regulations, 2012 (Canada Labour Code (Part I)): SOR/2014-243 is now in force. These regulations amends the Regulations to align them with the Administrative Tribunal Support Service of Canada Act, which creates a new agency that will be responsible for providing all support services to the Board. These are technical amendments and have no substantive impact on Board operations.

Règlement de 2012 sur le Conseil canadien des relations industrielles

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2015-47 adds 9 substances to Part 1, deletes 1 substance from Group A in Part 2 and adds 14 substances to Part 3. SOR/2015-48 replaces 1 substance in Part 1.

Consumer Chemicals and Containers Regulations, 2001 (Hazardous Products Act): SOR/2015-17 amends the regulation to acknowledge the impending repeal of the Controlled Product Regulations under WHIMIS 2015.

Export of Substances on the Export Control List Regulations (Canadian Environmental Protection Act, 1999): DORS/2015-19 amends the regulation to remove the term "material safety data sheet" and replaces it with the current terminology "safety data sheet". As well, it references the new Hazardous Products Regulation.

New Substances Notification Regulations (Canadian Environmental Protection Act, 1999): DORS/2015-19 amends the regulation to remove the term "material safety data sheet" and replaces it with the current terminology "safety data sheet".

Règlement sur les renseignements concernant les substances nouvelles (substances chimiques et polymères)

Passenger Automobile and Light Truck Greenhouse Gas Emission Regulations (Canadian Environmental Protection Act, 1999): SOR/2014-207 builds on the current GHG emission reduction plans. These regulations were developed in collaboration with the United States Environmental Protection Agency (U.S. EPA) to ensure alignment of Canada’s regulations with those of the United States. The regulations for progressively more stringent annual fleet average GHG emission standards over the 2017 to 2025 model years, with flexible compliance rules.

Section 2.A British Columbia Acts

Workers' Compensation Act : B.C. Reg. 224/2014 is now in force. Terminology in Schedule B has been updated regarding tendinopathies. As well, the use of claimant has been amended to read "worker" in several places, but not all the uses of "claimant" have been removed.

Section 2.B British Columbia Regulations

Occupational Disease Recognition Regulation (Workers' Compensation Act): B.C. Reg. 224/2014 is now in force. It amends the regulation to remove Epicondylitis (lateral and medial), Stenosing Tenovaginitis (Trigger Finger), Tendinitis, Tenosynovitis (other than the forms of tendinitis and tenosynovitis mentioned.
