INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in July 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in July 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada Transportation Act : S.C. 2015, c. 31, sections are in force to strengthen the liability and compensation regime for federally regulated railway companies by establishing minimum insurance levels for railway companies and a supplementary, shipper-financed compensation fund to cover damages resulting from railway accidents involving the transportation of certain dangerous goods.

First Nations Land Management Act: SOR/2016-67 adds items 114-119 to the Schedule (First Nations that have signed the Framework Agreement).

Food and Drugs Act : S.C. 2012, c. 25 is in force adding s. 2.1 (Non-corrective contact lenses) deeming them to be a device.

Explosives Regulations, 2013 (Explosives Act): SOR/2016-75 makes amendments to update references to two key standards: the 1995 Quantity Distance Principles - User’s Manual and the Storage Standards for Industrial Explosives, May 2001. A few minor technical changes have also been made.

Metal Mining Effluent Regulations (Fisheries Act): SOR/2016-87 adds item 24 (A portion of Trail Creek BC) to Schedule 2.

Pest Control Products Regulations (Pest Control Products Act): SOR/2016-61 makes amendments to correct discrepancies between the English and French versions, and to add clarity to certain regulatory provisions.

Règlement sur les produits antiparasitaires

Port Authorities Operations Regulations (Canada Marine Act): SOR/2016-66 repeals Parts 2 and 6 of Schedule 1, amends items in Part 17 and amends Schedule 2.

Precursor Control Regulations (Controlled Drugs and Substances Act): SOR/2016-12 adds item 25 (Alpha-phenylacetonitrile and its salts, isomers and salts of isomers) to the Schedule.

Climate Change and Emissions Management Act : S.A. 2016, c. 16 is in force adding definitions for "Independent System Operator" and "Provincial corporation" to s. 10 and adding other purposes for which the Management Fund may be used. Section 60 is also amended.

Environmental Protection and Enhancement Act : S.A. 2016, c. 7 is in force replacing s. 15 and adding ss. 15.1-15.3 regarding monitoring and reporting.

Historical Resources Act : S.A. 2016, c. 18 is in force making a minor amendment to s. 38.

Public Health Act: S.A. 2016, c. 9 is in force amending s. 70 (Intoxicating gas or vapour) regarding physicians and dentists.

Workers' Compensation Act: S.A. 2016, c. 9 s. 30 replaces 24.2(1)(d) regarding the definition of physician.

Section 2.B Alberta Regulations

Alberta Energy Regulator Administration Fees Rules (Responsible Energy Development Act): Alta. Reg. 63/2016 amends subsections 2(2) and 3(2) to change the fiscal year to 2016-17 and the annual adjustment factor. Administration fees for coal mines and oil sands projects are updated in ss. 4 and 5.

Beverage Container Recycling Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 104/2016 updates the date the regulation expires in s. 22.

Commercial Vehicle Safety Regulation (Traffic Safety Act): Alta. Reg. 60/2016 amends subsection 2(f) to update reference to NSC Standard 10 and repeals s. 50.

Conservation and Reclamation Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 103/2016 updates the date the regulation expires in s. 25.1.

Designated Material Recycling and Management Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 104/2016 updates the date the regulation expires in s. 18.

Distracted Driving Regulation (Traffic Safety Act): Alta. Reg. 65/2016 repeals s. 5 (date of expiry).

The purpose of this notice is to inform the public of the Ministry of the Environment and Climate Change's review of components of the Environmental Bill of Rights and to seek public feedback.

Proposed Amendments to Regulation 334 under the Environmental Assessment Act

The amendments to Regulation 334 are being proposed to ensure consistency with recently approved changes to legislation and existing requirements regarding the application of the Environmental Assessment Act, and to support other ministries and agencies in meeting government objectives and commitments.

Environmental Activity and Sector Registry Technical Discussion Paper for Plant and Production Processes with Air and Noise Emissions

The Ministry is seeking input on a technical discussion paper as a first step in considering the inclusion of select plant and production processes with air and noise emissions in the EASR. The proposal would require persons engaging in eligible activities that meet specified environmental requirements to register their activities in the EASR rather than apply for a traditional ECA under section 9 of the Environmental Protection Act (EPA).

Regulations under the Waste Diversion Transition Act, 2016

The Ministry of the Environment and Climate Change is proposing regulations under the Waste Diversion Transition Act, 2016 (WDTA) for the purposes of transferring the four waste diversion programs to the WDTA. Until the programs are wound-up and the wastes managed under the programs are transitioned to the new producer responsibility framework under the Resource Recovery and Circular Economy Act, 2016, the programs will operate under the WDTA.

Ministry of Labour Proposes to Mandate Construction Hazard Awareness Training

The Ministry of Labour is consulting on a proposal to amend the Occupational Health and Safety Awareness and Training Regulation (O. Reg. 297/13) under the Occupational Health and Safety Act to mandate hazard awareness training for construction workers.

Reg. 254/15 is in force adding the definition for "Passenger/Light-Duty Vehicle Inspection Standard" to s. 1, adding s. 4.3.1 and amending ss. 3, 8 and 10. Section 2.2 and Schedules 1 and 2 are repealed. O. Reg. 356/15 replaces the definition again in s. 1 for "Passenger/Light-Duty Vehicle Inspection Standard".
