INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in July 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in July 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of July 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Marine Liability Act : SOR/2015-98 repeals and replaces Paragraph 1 of Article 6 under Chapter II (Limits of Liability) in Schedule 1.

Section 2.B Canada Regulations

Motor Vehicle Restraint Systems and Booster Seats Safety Regulations (Motor Vehicle Safety Act): SOR/2015-111 amends the regulation to update the regulation to reflect changes made to section 10 of the Act. Section 110 (Content of notice of defect) has been repealed and replaced.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2015-111 amends the regulation to update the regulation to reflect changes made to section 10 of the Act. Section 15 (Defect Information) has been repealed and replaced.

Motor Vehicle Tire Safety Regulation : SOR/2015-111 amends the regulation to update the regulation to reflect changes made to section 10 of the Act. Section 13 (Content of notice of defect) has been repealed and replaced.

Pacific Aquaculture Regulations (Fisheries Act): SOR/2015-96 amends the regulation to authorize the collection of licence fees. An annual 2% inflationary increase to maintain a consistent cost recovery ratio.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2015-100 amends the regulation to introduce a new class of tank car for the transportation of flammable liquids, requiring thicker steel, full head shield protection, a thermally protected and jacketed care, top-fitting protection and new bottom outlet requirements. These amendments also require a new tank car used for flammable liquid dangerous goods service to be manufactured from October, 2015 to be built to the TC/DOT 117 standard.

Vessel Registration and Tonnage Regulations (Canada Shipping Act, 2001): SOR/2015-99 amends the regulation eliminate the requirement of small vessel registrations required for some owners and operators, small businesses, charitable organizations, and governments.

Wild Animal and Plant Trade Regulations (Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act): SOR/2015-81 amends the regulation to conform to Canada’s obligations under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). These amendments align the regulatory framework with other parties to CITES including the United States and the European Union.

Division 2 BRITISH COLUMBIA AMENDMENTS

Section 2.A British Columbia Acts

Passenger Transportation Act : S.B.C. 2015, c. 12 amends the Act to add a definition for "transit system" and section 39.1 (Power to Exempt).

Workers Compensation Act : S.B.C. 2015, c. 22 amends section 46 to to expand the list of people the court may restrain from carrying on any industry or activity in an industry. Sections 175 (Preliminary investigation, report and follow-up action) and 176 (Full investigation, report and follow-up action) have been repealed and replaced. Amendments to section 191 to expand the circumstances, in which, the Board may order to stop work under this section. S.B.C. 2015, c. 10 is partly in force to amend section 232 and repeals and replaces section 245.1 (Application of Administrative Tribunals Act to appeal tribunal) B.C. Reg. 32/2015 updates the fees listed throughout this regulation.

Section 2.B British Columbia Regulations

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. Reg. 43/2015 amends section 30.11 (No-alcohol restriction for Class 7L, 8L, 7 and 8 licences) of the regulation. The Alco-Sensor FST was added a prescribed device under section 90.3 of the Motor Vehicle Act.

Passenger Transportation Regulation (Passenger Transportation Act): B.C. Reg. 29/2015 amends section 3 (Passenger directed vehicles) and B.C. Reg. 44/2015 amends section 9 (When passengers may stand) of the regulation.

Reg. 419/05: Air Pollution - Local Air Quality). A technical standard is a technology-based compliance approach designed for two or more facilities in a sector that may not be able to meet one or more air standards due to technical or economic limitations.
