INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in June 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in June 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of June 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Wildlife Act : S.B.C. 2014, c. 7 is brought partly into force. In addition to consequential amendments, section 54 (Issue of assistant angling guide licence) has repealed the authority to issue assistant guide licenses. Sections 110.1 and 110.2 have been added to the Act to set out transitional provisions respecting assistant guide licences.

Source protection plans for the 38 source protection areas were prepared by the 19 source protection committees in the province.

Amendment to Ontario Regulation 347/07 under the Provincial Parks and Conservation Reserves Act, 2006 The Ministry of Natural Resources and Forestry is considering an amendment to Ontario Regulation 347/07 (Provincial Parks: General Provisions) to enable the extension of private cottage lot tenure in Algonquin Provincial Park beyond 2017.

Amendment to the Foundries - Industry Standard under the Local Air Quality Regulation (O. Reg. 419/05) (source: Environmental Registry) In 2010, the Canadian Foundry Association (CFA) expressed interest in updating the Foundries Industry Standard by expanding the list of contaminants and sources. This proposal is to amend an existing Industry Standard, namely the Foundries - Industry Standard (FIS), which is contained in the Ministry's "Technical Standard Publication" version 1.0 of (see EBR # 010-6588).

Construction Projects Regulation (O. Reg. 213/91): Ministry of Labour Proposes to Strengthen Health and Safety Requirements related to Suspended Access Equipment

Metal Finishers - Industry Standard under the Local Air Quality Regulation (O. Reg. 419/05) (source: Environmental Registry) The metal finishers sector has approached Ministry of the Environment and Climate Change (MOECC) with a request to develop a proposed Technical Standard under the local air quality regulation (O. Reg. 419/05: Air Pollution - Local Air Quality). A technical standard is a technology-based compliance approach designed for two or more facilities in a sector that may not be able to meet one or more air standards due to technical or economic limitations.

Ministry of Labour Proposes to Strengthen Health and Safety Requirements related to Suspended Access Equipment The Ministry of Labour is consulting on a proposal to strengthen requirements related to the operation of suspended access equipment set out in the Construction Projects Regulation (O. Reg. 213/91) under the Occupational Health and Safety Act.

Comments Due Date: June 22, 2015

Ministry of Labour proposed changes to O. Reg. 490/09- Designated Substances under the Occupational Health and Safety Act. The Ministry of Labour is proposing changes to O. Reg. 490/09- Designated Substances and the Codes for Medical Surveillance, Respiratory Protection and Measuring.

Preventing wildland fires caused by industrial operations (source: Environmental Registry) To seek public and industry stakeholder input on the proposal to amend Ontario Regulation 207/96 under the "Forest Fires Prevention Act" to extend the requirement for wildland fire prevention currently in place for the forest industry to all other industrial operations in forested areas within the legislated fire region, and to seek comments on the draft Industrial Operations Protocol, which describes most of the proposed requirements in greater detail.

Act respecting compensation measures for the carrying out of projects affecting wetlands or bodies of water : S.Q. 2015, c. 9 amends s. 5 to extend the application of s. 2, which allows such measures to be required in the case of an application for authorization under section 22 or 32 of the Environment Quality Act, to 24 April 2017.

Act respecting occupational health and safety : S.Q. 2015, c. 13 is in force June 3, 2015 replacing the concept of "controlled product" with "hazardous product" and sets out the terms governing the identification of hazardous products, as well as the requirements regarding the training and information employers give workers with respect to such products.
