INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in January 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in January 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

On Board Trains Occupational Health and Safety Regulations (Canada Labour Code (Part II - Occupational Safety and Health): SOR/2015-143 amends the regulation to outline new sound level exposure restrictions and introduce engineering controls to reduce employee exposure to noise. Employees must now be trained in basic first aid. Employers governed by this regulation must now develop and implement a hazard prevention program and implement controls that prevent workplace violence, ergonomics-related hazards, and other unsafe or harmful working conditions. Health and safety standards, such as those related to hazardous substances and personal protection equipment, have been updated.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Building Code Act : S.O. 2015, c. 28 amends section 8 (Building permits).

Fire Protection and Prevention Act : S.O. 2015, c. 34 amends the Act to add sections 46.2 (Employers not to interfere with associations), 46.3 (Associations not to interfere with employers’ organizations), 46.4 (Employers not to interfere with firefighters’ rights), 46.5 (No interference with bargaining rights), 46.6 (Intimidation and coercion), 46.7 (Persuasion during working hours), 46.8 (Protection of witnesses’ rights), 46.9 (Removal, etc., of posted notices), 52.1 (Deduction and remittance of association dues) 52.2 (Permissive provisions) 52.3 (Religious objections) 53.0.1 (Referral of grievances to a single arbitrator) 56.1 (Inquiry, alleged contravention), 56.3 ("person" defined for purposes of ss. 46.8 and 56.1), and 56.4 (Transition rules).

Highway Traffic Act : In addition to other amendments dealing with pedestrian crossings, S.O. 2015, c. 14 amends the Act by adding section 210.1 (Out-of-province evidence re vehicle ownership). Administrative amendments have been made by S.O. 2015, c. 27.

Planning Act : S.O. 2015, c. 26 is now partly in force. Section 22.1 (Interpretation of transitional provisions) has been added to the act. Other updates and housekeeping amendments have been made. S.O. 2015, c. 28 amends the Act to update and make the it accurate.

Provincial Offences Act : S.O. 2015, c. 27, Sch. 1 amends the Act to make housekeeping amendments as required.

Workplace Safety and Insurance Act, 1997 : S.O. 2015, c. 34 amends the Act to add sections 22.1 (Prohibition, claim suppression), 48.1 (Average earnings - death benefits), 176.1 (Appointment of Fair Practices Commissioner).

Section 2.B Ontario Regulations

Commercial Motor Vehicle Inspections (Highway Traffic Act): O. Reg. 330/15 amends the regulation to update the definition for "commercial motor vehicle".

Commercial Motor Vehicle Operators' Information (Highway Traffic Act): O. Reg. 331/15 adds section 1.0.1 to the regulation.

General Regulation (Environmental Assessment Act): O. Reg. 266/15 amends the regulation to add section 7.2, concerning exemptions from the Act.

General Regulation (Smoke-free Ontario Act): O. Reg. 336/15 is partly in force. Section 11 has been repealed, while Sections 10 (Signs at retail), 16 (Procedure for employees) and 25 (Signs, automatic prohibition) have been replaced.

Over-Dimensional Farm Vehicles (Highway Traffic Act): O. Reg. 334/15 amends the section 1 and the Schedule of this regulation.

Safety Inspections (Highway Traffic Act): O. Reg. 329/15 is now in force, as of January 1st, 2016. This regulation amends section 8 (Commercial Vehicles).

Source Protection Committees (Clean Water Act): O. Reg. 310/15 amends the regulation to repeal sections 5 and 21 and replace sections 8 (Term of Appointment) and 16 (Meetings). Section 1 has been amended regarding transitional committee membership composition based on the application of O. Reg. 310/15.

Transfer of Containers to Brewers Retail Inc. and Others (Environmental Protection Act): O. Reg. 294/15 amends section 1 (Prohibition) of the regulation.

Act respecting industrial accidents and occupational diseases : S.Q. 2015, c. 15 is in force making amendments as a result of the reorganization of certain labour institutions. The Administrative Labour Tribunal is established to replace the Commission des lésions professionnelles and the Commission des relations du travail and take over their jurisdictions.

Building Act : S.Q. 2014, c. 1, s. 781 is in force replacing "any writ" in s. 146 with "any decision". S.Q. 2015, c. 15 is in force amending ss. 129.11.1 and 152.1 to reference the Administrative Labour Tribunal Fund.

Highways and Transportation Act, 1997 : S.S. 2015, c. 29 is in force replacing s. 55 regarding awarding of contracts.

Traffic Safety Act : S.S. 2015, c. 33 is in force adding s. 40.1 (Facial recognition to verify person), and other amendments, such as extending the time period from 90 to 120 days after the date of the issuance of the notice of suspension to participate in an education or recovery program, replacing s. 247 (rules re helmets and goggles) and replacing the definition of "owner" in clause 273(1)(c).

Section 2.B Saskatchewan Regulations

Gas Inspection Regulations (Gas Inspection Act): Sask. Reg. 105/2015 increases the penalty in s. 13.1 for performing work of gas installation without a permit and replaces s. 16 (Standards for installations) to update references to CSA standards.
