INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in February 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in February 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada-Newfoundland and Labrador Atlantic Accord Implementation Act : S.C. 2014, c. 13 is in force making extensive amendments, including the addition of Part III.1 (Occupational Health and Safety).

Canada Marine Act : S.C. 2014, c. 39 amends the Act providing the ability to make regulations concerning undertakings in ports. It also authorizes those regulations to incorporate by reference documents, including the laws of a province. As well, it authorizes port authorities to acquire federal property and lease or license property that is not owned by the Crown.

Explosives Act : S.C. 2004, c. 15 is now in force with respect to this Act. Section 9 (Permits) has been repealed and replaced.

Civil and criminal immunity has been extended to organizations and mandataries engaged in response operations. As well, some new enforcement measures, including an administrative monetary penalties have been added.

SOR/2014 227 adds 4 substances to Part 1. SOR/2014-241 adds 7 substances to Part 1 and adds 14 substances to Part 3. SOR/2014-288 by adding I item under organisms in Part 5. SOR/2015-7 adds 11 substances to Part 1 and 19 substances to Part 3.

Motor Vehicle Safety Regulations (Motor Vehicle Safety Act): SOR/2015-23 replaces the definition of "school bus" and adds the definition for "multifunction school activity bus" in subsection 2(1). Paragraph 6(1)(f) and subsections 108(13) and 131(1) are amended. SOR/2015-24 replaces the definition of "display" in subsection 2(1) and replaces portion of item 101 in column 2 of Schedule III. It replaces s. 101 of Schedule IV with a new Canadian safety standard (Controls, Tell-tales, Indicators and Sources of Illumination) and amends ss. 105, 122, and 135.

Division 2 BRITISH COLUMBIA AMENDMENTS

Section 2.A British Columbia Acts

Forest Act : S.B.C. 2014 c. 7 amends the Act to brings into force the addition of section 75.12 (Bonus bid equalization payment for attributed timber volume) and updating the language of section 111. S.B.C. 2013, c. 12 is partly in force enacting section 14.2 (Supplemental forest licence).

Section 2.B British Columbia Regulations

Administrative Penalties Regulation (Oil and Gas Activities Act): B.C. Reg. 213/2014 amends the regulation and adds section 10 (Liquefied Natural Gas Facility Regulation).

Environmental Protection and Management Regulation (Oil and Gas Activities Act): B.C. Reg. 214/2014 amends the regulation to repeal the definition for ‘operating area’.

Fee, Levy and Security Regulation (Oil and Gas Activities Act): B.C. Reg. 202/2014 amends the regulation to update section 23 (Levy).

Motor Vehicle Act Regulations (Motor Vehicle Act): B.C. 211/2014 amends section 41.01 (Devices prescribed).

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 199/2014 is in force amending s. 4.1.1 and adding s. 4.1.2 (Avalanche risk assessment and safety plan exception). Sections 5.3, 5.27, 11.2, 13.5, 13.32, 20.26, 20.112 and 26.65 are amended. Sections 12.175-182 (Roll-on/Roll-off Containers) and Part 34 (Rope Access) are added. Section 28.12 is repealed.

Oil and Gas Activities Act General Regulation (Oil and Gas Activities Act): B.C. Reg. 214/2014 amends the regulation to repeal the definition for operator.

Wildfire Regulation (Wildfire Act): B.C. Reg. 190/2014, amends the definition for "qualified holder".

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Ontario Water Resources Act, 2007 : S.O. 2007, c. 12 is now fully in force. The Safeguarding and Sustaining Ontario’s Water Act, 2007 recognizes and implements the Great Lakes-St. Lawrence River Basin Sustainable Water Resources Agreement of 2005. The agreement recognizes that the waters of the Great Lakes Basin are a shared and the parties to the Agreement have a shared duty to protect, conserve and manage this resource. The parties have committed to efforts that would maintain and promote the continuation of a sustainable, accessible and adequate water sources for the people and economy of the Basin.

Safe Drinking Water Act, 2002 : S.O. 2007, c. 12 is now fully in force. The Safeguarding and Sustaining Ontario’s Water Act, 2007 recognizes and implements the Great Lakes-St. Lawrence River Basin Sustainable Water Resources Agreement of 2005. Several sections have also been amended to reflect current regulatory requirements under the Ontario Water Resources Act.

Section 2.B Ontario Regulations

Approval Exemptions (Ontario Water Resources Act): O. Reg. 301/14 amends the regulation to add section 3.3

Commercial Motor Vehicle Inspections : O. Reg. 242/14 amends the regulation to update the use of "motor coach" with the term "inter-city bus". As well, schedules 3 - 5 have been updated.

Designation and Exemption of Integrated Power System Plan : O. Reg. 284/14 amends the regulation to repeal and replace section 1 (Definition), which replaces the definition for "integrated power system plan".

Designation of Goods, Services and Technologies (Green Energy Act, 2009): O. Reg. 287/14 amends section 1 of the regulation.

General (Smoke-Free Ontario Act): O. Reg. 206/14 amends the regulation to repeal and replace section 8 (Prohibition of sale in designated places). Section 13 (Restaurant and bar patios) has been repealed and replaced. As well, sections 13.1 (Children’s playgrounds and play areas) and 13.2 (Sporting areas, etc.) These amendments increase the classes of areas where smoking is prohibited.

General (Weed Control Act): O. Reg. 248/14 amends the regulation to replace the Schedule (Noxious Weeds) and repeal the Form and replace it with one named "Order to Destroy Noxious Weeds or Weed Seeds" available on the website of the Government of Ontario Central Forms Repository.

Propane Storage and Handling (Technical Standards and Safety Act, 2000): O. Reg. 196/14 amends the regulation to replace subsection 3.1(0.2) dealing with Level 1 risk and safety management plans as well as amending section 27.1 (Licensing of certain facilities).
