INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in March 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in March 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of March 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Safety Codes Act : S.A. 2015, c. 10, s. 41 in force amending s. 66 respecting bylaws and private sewage disposal systems.

Section 2.B Alberta Regulations

Building Code Regulation (Safety Codes Act): Alta. Reg. 31/2015 s. 2 and subsection 4(4) are in force (the National Energy Code of Canada for Buildings 2011 is in force for buildings).

Electrical Code Regulation (Safety Codes Act): Alta. Reg. 126/2015 updates references to standards in s. 3 and repeals the Schedule.

Emissions Trading Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 180/2015 changes the date that the regulation expires in s. 59.

Gas Code Regulation (Safety Codes Act): Alta. Reg. 193/2015 updates references to standards and repeals Schedules 1 to 5.

Metallic and Industrial Minerals Exploration Regulation (Mines and Minerals Act): Alta. Reg. 183/2015 amends the date that the regulation expires in s. 46.

Mercury Emissions from Coal-fired Power Plants Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 200/2015 amends the date that the regulation expires in s. 13.

Motor Vehicle Gas Conversion Regulation (formerly Motor Vehicle Propane Conversions Regulation (Safety Codes Act): Alta. Reg. 179/2015 changes the title of the regulation, amends ss. 1, 2 and 12 and repeals s. 10.

Occupational Health and Safety Code 2009 (Occupational Health and Safety Act): S.A. 2015, c. 19 is in force adding s. 1.1 (Farming and ranching operations).

Permit Regulation (Safety Codes Act): Alta. Reg. 194/2015 replaces s. 6 (Building permit).

Pressure Equipment Safety Regulation (Safety Codes Act): Alta. Reg. 195/2016 adds "safety codes officer" to several sections and updates codes and standards in s. 6.

Private Sewage Disposal Systems Regulation (Safety Codes Act): Alta. Reg. 196/2015 making amendments related to municipalities making bylaws restricting the type of systems that can be constructed or used in new installations of private sewage disposal systems.

Specified Gas Emitters Regulation (Climate Change and Emissions Management Act): Alta. Water (Ministerial) Regulation (Water Act): Alta. Reg. 185/2015 amends the date that the regulation expires in s. 16.

Safety Standards Act: S.B.C. 2015, c. 10 is in force amending s. 43 and replacing s. 44 (Application of Administrative Tribunals Act).

Water Act : S.B.C. 2015, c. 10 is in force amending s. 92 regarding appeals. R.S.B.C. 2015, c. 1 makes a minor amendment to s. 50

Wildfire Act : S.B.C. 2015, c. 10 is in force amending ss. 39-41 and adding s. 40.1 (Procedure on appeals).

Wildlife Act: S.B.C. 2015, c. 10, s. 197 is in force amending s. 101.1 regarding appeals.

Section 2.B British Columbia Regulations

Carbon Tax Regulation (Carbon Tax Act): B.C. Reg. 102/2015 replaces section 24 Refund or deduction for bad debts.

Conservation Officer Service Authority Regulation (Environmental Management Act): B.C. Reg. 193/2015 makes a minor amendment to s. 1.

Drilling and Production Regulation (Oil and Gas Activities Act): B.C. Reg. 159/2016 amends definitions in s. 1; adding subsections including to ss. 6, 7, 41, 49, 51, 67 78, 80; and adding new section s. 21.1 Induced seismicity. B.C. Reg. 165/2016 makes a minor amendment to s. 21.1 (2).

Fee, Levy and Security Regulation (Oil and Gas Activities Act): B.C. Reg. 131/2015 makes minor amendments to ss. 23 and 24.

Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Smoke-Free Ontario Act : S.O. 2015, c. 7, Sch. 2, sections are in force prohibiting the sale of flavoured tobacco products, with some exemptions; doubling the maximum fines for those who sell tobacco to youth; strengthening the enforcement authority to address indoor use of tobacco in water pipe bars and restaurants; expanding the seizure authority of inspectors; and prohibiting smoking on outdoor grounds of hospitals, psychiatric facilities and the outdoor grounds of specified office buildings owned by the Province, except in designated smoking areas.

Section 2.B Ontario Regulations

Building Code (Building Code Act, 1992); Sentences 4.2.1.1.(1),(4), and (5) are in force Jan. 1 2016 regarding excavations and foundation systems for buildings.

Construction Projects (Occupational Health and Safety Act): O. Reg. 345/15, some sections are in force making amendments relating to the safe operation of rotary foundation drill rigs ("drill rigs), strengthening fall protection measures and correcting inconsistencies and clarifying requirements.

Energy Efficiency - Appliances and Products (Green Energy Act, 2009): O. Reg. 412/15 makes extensive amendments.

Firefighters (Workplace Safety and Insurance Act, 1997): O. Reg. 113/14 parts are in force adding primary-site lung cancer to the list of prescribed diseases in s. 4 and amending s. 5 (conditions and restrictions).

Fish Licensing (Fish and Wildlife Conservation Act, 1997): O. Reg. 352/15 parts are in force amending s. 34 with respect to commercial fishing royalties.

General (Endangered Species Act, 2007): O. Reg. 387/15 amends O. Reg. 197/11 to change the date of the repeal of s. 4.1 (bobolinks) to Dec. 31, 2025.

General Regulation (Environmental Assessment Act): O. Reg. 414/15 adds exemptions from the Act to s. 7.2.

General (Safety and Consumer Statutes Administration Act, 1996): O. Reg. 286/15 adds the Funeral, Burial and Cremation Services Act, 2002 as designated legislation in s. 1 and 2.2.

Restricted Use of Left Lanes by Commercial Motor Vehicles (Highway Traffic Act): O. Reg. 1/16 amends schedule 2 by adding items 4 and 5 related to Kingston.

Materials Stewardship and Recycling Regulations (Environmental Protection Act): EC2015-603 is in force amending s. 1 to clarify that oil and glycol containers, as well as aerosol containers for brake cleaner, are included in the regulations.

Ozone Layer Protection Regulations (Environmental Protection Act): EC2015-779 is in force updating references to standards in ss. 9 and 10.

Pesticides Control Act Regulations (Pesticides Control Act): EC2015-656 is in force making amendments to schedules 7 and 8 to update the list of exempted pesticides and update the list of self-select pesticides for domestic use.

Petroleum Hydrocarbon Remediation Regulations (Environmental Protection Act): EC2015-541 is in force replacing Tables 1 to 4 of Schedule A to align with federal criteria.
