INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in October 2014. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in October 2014. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2014 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Marine Transportation Security Regulations(Marine Transportation Security Act): SOR/2014-162 amends the regulation to harmonize the regime, where possible, with that of the United States due to a misalignment of lists of certain dangerous cargoes (CDC) between Canada and the United States. Other amendments have been made to fulfill Canada’s international obligations, clarify the regulation due to interpretation issues and fill regulatory gaps. Lastly, amendments have been made as a part of the Red Tape Reduction initiative.

Highway Traffic Act: S.P.E.I 2014, c. 32 amends the Act to add definitions for "daytime running lights", "headlights" and "headlamps and several provisions concerning the use of such lights. Subsection 113(3) is repealed as it was not consistent with the new material, which in fact requires the use of daytime running lights during daylight hours. Sections dealing with prohibited and exempted right-hand drive vehicles have been amended. Fines have also been established for new sections. S.P.E.I 2014, c. 33 adds a new definition of "restricted number plate" to the Act and amends other sections concerning such plates. Section 73 is amended dealing with alcohol ignition interlock in respect of the Criminal Code. As well, section 89 of the Act was amended to establish offences in respect of these amendments.

Public Health Act: S.P.E.I 2014, c. 43 amends the Act to clarify certain sections and update terminology used.

Section 2.B Prince Edward Island Regulations

Code for Plumbing Services(Environmental Protection Act): EC2014-85 amends the regulation to reference the most recent edition of National Plumbing Code of Canada. Section 3 is amended to require potable water treatment devices be installed in accordance with the Code. Sections 5.1 (Low flow fixtures) and 5.2 (Plumbing contractor’s license) have been added to the regulation. Schedule A has been added to the regulation to setting out a maximum water consumption for toilets and urinals.
